The applicant explained that he has talked to the bartenders about over serving patrons (and underage patrons) regarding the item on the police report. Ald. Brostoff asked if the underage patron on the police report was checked. The applicant said that it was situation that fell through the cracks but that he has been doing it since then. He added that he has over 100 fake ids. Ald. Brostoff asked if he was aware about the noise complaints from the neighbors. The applicant said that he was not aware about the noise complaints and that he would have addressed them. He added that he could turn off the speakers if he needs to. Individuals in objection: Kevin Glowicki (did not provide his address due his journalism activity) read an statement. Ald. Spiker asked the witness to be specific about his statement. Mr. Glowicki said that he worked for four months there and that he personally saw that the id scanner was not used, that underage patrons come in by the back door, that he saw once a security guard selling a fake id to a patron, that expired food is served, and that there is sexual harassment. Individuals also present: Ald. Brostoff said that he talked to the witness and that he wants to make a correction to what was said about that conversation and that most of those items must be resolved at court. He added that those are horrible accusations and that the only complaint that he has heard is about the noise. He said that he would like to hold this application to dig further because of the severity of the claims. The applicant said that he holds licenses here and another six municipalities, that he takes the license liability very seriously and that 85% of the article presented by Mr. Glowicki is false. He added that he has strict policies, that he would take the proper steps to address any serious accusations like sexual harassment. He added that the witness is an ex-employee, that he stills reach out to his current employees, that they all have blocked this witness. He also said that the alley of the article on file is false and that we need to look into the witness’ background. Ald. Burgelis asked if he is aware about any formal sexual harassment accusations. He explained that one of the items had to do with removing people from the premises and somehow turned out against him. No neighbors were present to testify. Individuals also present: Ald. Bauman said that this business has been operating for few years within the same family, that it is necessary at this location because there are hotels and apartment buildings around. He also asked the applicant if there is a chance to clean the windows for a better curb appeal. The applicant said that they get the windows broken from time to time and that is why they cover them with cardboard. He added that he is looking forward to change the glasses. Mr. Cooney said that the applicant mentioned that he will continue business as usual but that this application do not reflect the condition for selling single unit containers as the current one. Zak Wroblewski appeared on behalf of the applicant along with Melissa Nelson-Bohan.(Multi-Unit Manager). Atty. Wrobleski said that half of the items on the police report are indirectly related to the business or welfare checks but that no business wants to see a lengthy report like this one. He also said that his client is taking it seriously, that they have been in communication with Ald. Spiker and that they have addressed the security concerns. He added that they have a new manager since July of 2023, that they have seen more stable results since then, that they have hired a new security company (Wisconsin Public Safety Agency) because the previous one was unreliable. He also said that they have an armed security guard from Thursday to Saturday, from 10pm to 6am along with a squawker vehicle with flashing lights on. He also mentioned that they have 12 surveillance cameras inside and 2 outside and that they are currently upgrading the system to be shared with managers and police. Individuals also present: Ald. Burgelis asked if the number of incidences not reported has declined just as the reported ones due the new management and why the footage for item 26 was not provided. Atty. Wroblewski said that the unreported incidences have slowed down and Ms. Nelson said that the manager did not have access to the surveillance video. Atty. Burgelis asked if there was an intention to share the video with MPD later. Ms. Nelson said that there was not a request to do so. Ald. Spiker asked when the new security company was hired. Ms. Nelson said that on April 5, 2024. Ald. Spiker asked Mr. Cooney when did police report cut off. Mr. Cooney said that the cut off date was March 7, 2024 so everything what happened after, is not considered on this police report. Ald. Spiker said that the committee cannot see yet the results of having the new security plan in place because of the cut off date. He also asked what happened on item 13 and why the staff did not cooperate with the police even if the incident did not happen at the establishment. Atty. Wrobleswki said that it was the previous manager. Ald. Spiker asked to Ms. Nelson if this incident came to her attention prior letting the manager go. Ms. Nelson said that they were made aware of, that the manager was going thru a performance action plan and she just walked out one day without locking the restaurant on a Friday night. Ald. Spiker asked what are they going to do to avoid fights over food with guns involved, in a non-alcohol environment and with an armed security guard on site. Atty. Wrobleski said that it is not an alcohol establishment but that at 4am they don’t know if patrons are coming from a bar or something like that. He also said that he believes that this incident happened when the security guard was not there and that having the armed security guard Thu-Sat, from 10pm to 6am will prevent those situations. Ms. Nelson said that there was no security guard. Ald. Spiker asked for some more information about the new security company. Ms. Nelson said that the security company is larger, licensed and bonded with backups available. No neighbors were present to testify. Ald. Spiker moved to include the e-mailed plan of operations into the record. There were no objections. Ald. Spiker moved renewal of the food license and renewal with a 15 day suspension of the extended hours establishment license based upon the preponderance of the evidence on the police report, aldermanic and applicant testimony that demonstrates the operation results in a threat to health, safety or welfare of the public for the disturbing after hours incidents involving weapons, fights, lack of a reliable security company and poor management and; to give time to the new security to present results. She added that she has been in communication with this applicant, that neighbors don’t forget what happened before and that she made some recommendations to the applicant in order to give a piece of mind to the neighbors. Mr. Cooney said that the question is if the applicant is willing to withdraw the Public Entertainment Premises application. Ald.
